General terms and conditions of the Association of Airline Travel Agents and Business Travel Agencies affiliated to the ANVR (Dutch Association of Travel Agents and Tour Operators) [Vereniging van ANVR Luchtvaartagenten en Zakenreisbureaus] (VLZ)  

1. Scope

1.1 These General Terms and Conditions govern the legal relationship between a business travel agency on the one hand and its client(s) on the other hand.

1.2 As regards the scope of these terms and conditions and the ANVR travel and/or booking conditions [ANVR Reis- en/of boekingsvoorwaarden],only the present terms and conditions apply if the client is a natural person or legal entity acting within the framework of a profession or business.

2. Definition of terms

2.1 Business travel agency: the party that, within the framework of its business, provides information and advice relating to travelling in the widest sense of the word, and acts as an intermediary in the drawing up of agreements between the client and third parties regarding the provision of travel-related services (the service provider).

2.2 The client: the party that commissions the business travel agency to provide travel-related services.

2.3 Passenger: the natural person on whose behalf the agreement is entered into with the business travel agency and/or the service provider.

2.4 Service provider: the carrier, provider of accommodation or other services with whom the client enters into an agreement via the business travel agency in its capacity as an intermediary. The service provider is responsible for implementing the services with due regard for the terms and conditions that it applies.

3 Assignment

3.1 The contents of the services provided by the business travel agency may consist of informing and advising the client and acting as an intermediary on the client’s behalf in the drawing up of an agreement between the client and the service provider.
 
3.2 The client is bound vis-à-vis the business travel agency and the service provider by the terms and conditions of the assignment irrespective of whether a confirmation has been issued.

3.3 In the event that a confirmation is issued to the client, this confirmation will serve as proof of the content of the agreement(s), without prejudice to the provisions of 3.2.

3.4 The client is fully liable vis-à-vis both the business travel agency and the ultimate service provider for the obligations that result from the provision of services.

4 Provision of information

4.1 The client will provide the business travel agency with the information concerning the client and/or any other passengers that is required to enter into and implement the agreement, including addresses and telephone numbers of those who have to be contacted in the event of an emergency.

4.2 Depending on the service provider’s terms and conditions and in accordance with these terms and conditions, the rates for services may be changed. Such changes may also be made after the agreement has been entered into. Information regarding said changes will be provided and the related amounts will be charged as soon as possible. If a payment is owed for a service provided by the business travel agency itself, notice to this effect will be provided in advance.

4.3 No rate changes will be charged once the client and/or passenger has received the travel ticket and/or other travel documents.
  
4.4 The client must ensure that he or she and/or the other passengers have the necessary documents in their possession when they leave. These documents include a valid passport and any visa that may be required, as well as confirmations of inoculations and vaccinations.

4.5 The client and/or passenger will acquire the required additional information from the appropriate authorities and also confirm in good time before his or her departure that the information previously acquired is still correct.

4.6 The client and/or passenger must comply with the instructions given by or on behalf of the service provider and, in particular, with the applicable check-in times and/or recommended transfer times.

5 Changes and cancellations

5.1 Cancellations of, or changes to, assignments that have already been entered into may only take place at the client’s request and then only during the business travel agency’s normal opening times.

5.2 In the event of a cancellation at the client’s request or changes to reservations at the client’s request, the related costs will be charged. In addition to costs charged by the service provider, these may be costs that the business travel agency itself charges to cancel and/or change the reservation.

5.3 If the client cancels or changes the service directly, the related costs will be charged to the client.

6 Liability

6.1 The business travel agency will be as careful to comply with the interests of the client and the passenger as may reasonably be expected in the given circumstances.

6.2 The business travel agency accepts no liability for actions and/or omissions on the part of the service providers involved in the performance of the services, nor for the correctness of the information provided by these service providers, including the correctness of photographs, folder material and/or other information provided by, or on behalf of, these service providers. The business travel agency is not liable for insolvency on the part of the service provider.

6.3 If the business travel agency fails culpably, its liability for damage or loss suffered by the client and/or passenger will be limited to the cost of the journey as stated on the invoice. If the relevant agreement is dissolved, the business travel agency will refund any advance payments made over and above this amount.

6.4 The business travel agency is not liable for delays that the passenger suffers and any resulting loss or damage, whatever the cause. This includes, but is not limited to, delays caused by means of transport with technical defects, weather conditions, traffic congestion, strikes and/or pickets, missed connections, transfers, changes in the journey implemented by the service provider and cancellation by the service provider.

6.5 The exclusions and restrictions included in this section also apply to the travel agency staff.

7 Payment

7.1 All invoiced amounts must be paid to the business travel agency within fourteen days in the manner indicated by the business travel agency.

7.2 In the event of late payment, the client will immediately be in default and will owe the statutory interest over the outstanding amount. Moreover, the client will be obliged to pay extrajudicial costs, including the costs of determining the loss or damage and liability and the costs for ensuring payment out of court, estimated at 15% of the principal sum with a minimum applying of 70 euros.

8 Applicable law

8.1 All disputes that arise between the business travel agency and the client and/or passenger are subject to Dutch law.

8.2 Unless the business travel agency chooses otherwise, or unless prescribed as mandatory by the law that another court is authorised, the court in the business travel agency’s place of business will be authorised to take cognisance of disputes.

Schiphol Travel respects your privacy and ensures that personal details remain strictly confidential. Strict confidentiality will be maintained in respect of all details collected by Schiphol Travel. These details will not be loaned out, hired out or sold, nor published in any way. The information that you give to Schiphol Travel will be treated with the greatest possible care. Schiphol Travel will not make your personal details available to third parties in any way, except for the implementation of the journeys that you have booked.
